Terms & Conditions

We keep things simple: you check your proof, you approve it, we print it beautifully. Colours may shift a smidge between screen and real life, rush jobs move fast, and once you approve a proof, it’s all systems go. Custom orders can’t be returned, but if we make a genuine mistake, we’ll fix it. Easy.

1. Defintions

1.1 Key Terms
“Bendigo Graphics,” “we,” “us,” and “our” refer to the business trading as Bendigo Graphics. “You” and “Customer” refer to any individual or entity ordering products or services from Bendigo Graphics. “Goods” means printed items, apparel, signage, or any physical products we produce. “Services” refers to design, proofing, production, or related work.

2. General

2.1 Agreement to Terms
By placing an order with Bendigo Graphics, you agree to be bound by these Terms & Conditions.

2.2 Right to Amend
We may update or modify these Terms & Conditions at any time. The version active at the time of your order applies.

3. Quotes & Pricing

3.1 Quote Validity
All quotes are valid for 14 days unless otherwise stated.

3.2 Price Adjustments
Pricing may vary based on changes to materials, supplier costs, artwork adjustments, or additional customer requests.

3.3 Quote Acceptance
A quote does not constitute a binding agreement until accepted in writing by the Customer.

3.4 Deposits & Pre-Payment
Deposits or upfront payments may be required before work commences for orders exceeding $100.

4. Payment Terms

4.1 Payment Deadlines
Full payment is required prior to production unless written credit terms have been approved.

4.2 Late Payments
All invoices must be paid by the due date. Late payments may result in delays, suspension of services, or additional fees.

4.3 Ownership of Goods
Goods remain the property of Bendigo Graphics until payment is received in full.

5. Proofing, Design, and Customer Responsibilities

5.1 Proof Review & Accuracy
The Customer is responsible for reviewing all spelling, colours, layout, images, sizing, and design details in any provided proof. Approval confirms that all elements are correct and ready for production.

5.2 Revision Allowance
Each order includes one (1) additional proof round at no extra cost. Further revisions may incur an additional fee, which will be quoted and approved prior to continuation.

5.3 Approval Required Before Production
Production will begin only after written approval of the supplied proof. Delays in approval may affect turnaround times.

5.4 Colour Variation Disclaimer
Colours may vary slightly between on-screen previews and final printed results due to differences in screens, materials, inks, and print processes. We take reasonable steps to ensure colour accuracy but cannot guarantee exact matches.

5.5 Final Responsibility
By approving the proof, the Customer accepts full responsibility for all design elements and releases Bendigo Graphics from liability for any errors, inaccuracies, or omissions present in the approved proof.

5.6 Customer-Supplied Artwork
Where artwork is supplied by the Customer:

  • Files must meet our required specifications.

  • The Customer warrants they hold all necessary rights, licences, and permissions.

  • Bendigo Graphics is not responsible for errors, colour shifts, or issues arising from low-resolution or improperly prepared files.

5.7 Expedited Orders (Rush Jobs)
For expedited orders, the Customer must review and approve proofs as soon as possible.
If approval is not received within the required timeframe, Bendigo Graphics may proceed with the current proof to meet the requested deadline.
By requesting a rush job, the Customer agrees to this process and acknowledges the reduced revision flexibility.

6. Production Timeframes

6.1 Estimated Turnaround
All turnaround times are estimates and may vary based on workload, material availability, or external factors.

6.2 External Delays
Bendigo Graphics is not liable for delays outside our control, including courier delays, supplier issues, or unforeseen technical issues.

7. Delivery, Shipping & Collection

7.1 Delivery Options
Goods may be collected in-store or shipped to the Customer.

7.2 Transfer of Risk
Risk passes to the Customer upon collection or dispatch.

7.3 Delivery Fees
Applicable delivery charges, will be outlined prior to payment.

8. Returns, Refunds & Reprints

8.1 No Change-of-Mind Returns
Due to the customised nature of our work, refunds are not provided for change of mind.

8.2 Faulty or Incorrect Goods
If Goods are faulty or not produced according to the approved proof, Bendigo Graphics will, at its discretion, offer a repair, replacement, or reprint.

8.3 Claim Period
Claims must be made within 7 days of receiving the Goods.

8.4 Exclusions
Goods damaged due to customer mishandling, incorrect installation, or general wear and tear are not eligible for compensation.

9. Intellectual Property

9.1 Ownership of Created Materials
All original designs, concepts, templates, and materials created by Bendigo Graphics remain our intellectual property unless transferred in writing after full payment.

9.2 Ownership of Customer Content
Customer-supplied content remains the property of the Customer, and the Customer warrants they have the legal right to use such content.

9.3 Licence for Customer Use
Upon full payment, the Customer is granted a non-exclusive, non-transferable licence to use the final supplied files or printed materials for their intended business or personal purpose. 

9.4 Right to Use Completed Work for Promotion
Bendigo Graphics retains the right to showcase, publish, photograph, and share any completed work – including designs, printed products, signage, apparel, or in-progress imagery – for marketing, portfolio, social media, advertising, or promotional purposes.

9.5 Confidential or Sensitive Work
If a Customer requires a project to remain confidential (e.g., pre-launch campaigns, embargoed materials), they must notify Bendigo Graphics in writing before production begins.

10. Limitation of Liability

10.1 Scope of Liability
To the extent permitted by law, Bendigo Graphics excludes all liability for loss, damage, or consequential expenses arising out of:

  • Delays in production or delivery

  • Colour variations

  • Customer-supplied artwork issues

  • Errors approved in the proof

  • Third-party installation or misuse

10.2 Liability Cap
Our total liability is limited to the cost of the specific Goods or Services supplied.

11. Indemnity

11.1 Customer Indemnification

  • Use of Customer-supplied artwork

  • Copyright or trademark infringement

  • Misuse or modification of our products

  • Breach of these Terms & Conditions

12. Governing Law

12.1 Jurisdiction
These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria.
